1. General provisions
These Terms and Conditions apply to purchases made through the Vilbers online store. A purchase made by a consumer through the website constitutes a distance contract between the consumer and SIA Vilbers and is governed by these Terms and Conditions and the applicable legislation of the Republic of Latvia, including the Consumer Rights Protection Law and regulations governing distance contracts.
2. Making purchases
The prices and specifications of the products sold in the online store are indicated next to the products. To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Make payment for your purchase to complete your order.
3. Payment terms
The settlement currency on the site is Euro. The purchase can be paid for by choosing the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS: Latvian internet bank payments: Swedbank, SEB, Citadele and Luminor Estonian online bank payments: Swedbank, SEB, Luminor Lithuanian internet bank payments: Swedbank, SEB and Luminor Finnish online bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki Visa/Mastercard payments. Using the online banking payment method, confirm the order and click the "Return to merchant" button. Personal data required for making payments are transferred to the licensed payment institution Maksekeskus AS. The contract of sale enters into force once the payment has been successfully completed and confirmed. If for some reason it will not be possible to fulfill the order, the Buyer will be informed about it and the amount paid will be refunded as soon as possible, but no later than within 14 days after receiving the notification.
Worldwide payments: Stripe, Shop, Klarna, Visa/Mastercard & PayPal accepted, provided by the payment platform Stripe.
4. Terms of delivery
Vilbers delivers orders internationally to the destinations available at checkout. Available delivery methods, shipping costs and estimated delivery times depend on the destination and are displayed during checkout.
Purchased goods are delivered using parcel stations or courier.
For deliveries outside the European Union, additional import duties, customs fees or local taxes may apply depending on the destination. Unless otherwise stated at checkout, such charges are the responsibility of the customer. Shipping costs are displayed before the order is confirmed. Orders are generally dispatched within 5 business days after the order has been confirmed. The speed of delivery of goods depends on the country of delivery, the selected supplier and the type of delivery. Orders are generally dispatched within 5 business days. If an order cannot be dispatched within this period, we will inform the customer of the revised timeframe. In exceptional cases, dispatch may take up to 45 calendar days.
The shipping costs are calculated at the checkout.
5. Right of withdrawal
VILBERS offers an extended 60-day return period from the date the order is received. This voluntary return policy is provided in addition to any statutory consumer rights and does not limit the rights available to consumers under applicable law. To request a return, contact vilbers@vilbers.com or submit a return request through your customer account. Please contact us before sending the item back so that we can provide the necessary return instructions. Items may be inspected and tried on only to the extent necessary to determine their nature, characteristics and fit, similar to what would be permitted in a physical store. The customer may be responsible for any diminished value resulting from handling beyond what is reasonably necessary to inspect the item. Return shipping costs are borne by the customer unless the item is incorrect, damaged or otherwise non-conforming, or unless applicable law requires otherwise. VILBERS offers one free exchange per order, subject to product availability. Please contact us before returning an item for exchange so that we can confirm the replacement and provide instructions. The right of withdrawal may not apply in cases provided by applicable law, including goods made according to the customer's individual specifications or goods that are clearly personalised. A product is not considered personalised solely because it is made to order in a standard VILBERS size or configuration. The right of withdrawal may also not apply to sealed goods that are unsuitable for return for health protection or hygiene reasons once the seal has been opened after delivery. If you are unsure about sizing, fit, materials or other product details, please contact us before ordering and we will be happy to help.
Consumers entitled to the statutory EU right of withdrawal may withdraw from an eligible online purchase within 14 days after receiving the goods, without providing a reason. To exercise this right, you must inform VILBERS of your decision within the 14-day period by contacting vilbers@vilbers.com. The goods must then be returned without undue delay and no later than 14 days after notifying us of the withdrawal. Where the statutory right of withdrawal is exercised, VILBERS will refund payments received from the customer, including the cost of the least expensive standard delivery method offered, within the period required by applicable law. VILBERS may withhold the refund until the returned goods have been received or the customer provides evidence that they have been sent back, whichever occurs first.
6. Consumer's rights for non-conforming goods
The online store is responsible for any non-conformity of the goods with the terms of the contract that existed at the time of delivery and becomes apparent within two years from the date the goods were delivered to the consumer. If the non-conformity becomes apparent within one year from delivery, it is presumed to have existed at the time of delivery unless the nature of the goods or the nature of the non-conformity indicates otherwise. The consumer must notify the online store of the non-conformity within two months from the date on which it was discovered by contacting vilbers@vilbers.com. Where the goods do not conform to the contract, the consumer is entitled to the remedies provided by applicable consumer protection legislation. Depending on the circumstances, these may include repair or replacement of the goods, an appropriate reduction in price or termination of the contract and refund. The online store will provide a written response to the consumer's complaint within 15 business days.
7. Processing of personal data of the buyer
Personal data is processed in accordance with the Vilbers Privacy Policy. Personal data necessary for fulfilling an order may be disclosed to payment, delivery and other service providers involved in processing the order.
Marketing communications are sent only where the customer has provided the required consent or where another lawful basis applies. Customers may unsubscribe from marketing communications at any time using the unsubscribe link provided in the communication.
8. Dispute resolution procedure
Any complaints regarding the online store or purchased goods should first be submitted to the Seller by e-mail at vilbers@vilbers.com. The Seller will review the complaint and provide a response within 15 business days. If the Buyer and the Seller are unable to resolve the dispute by mutual agreement, the consumer may contact the Consumer Rights Protection Centre of Latvia (PTAC) for assistance or, where applicable, submit the dispute to the Consumer Dispute Resolution Commission or another competent out-of-court dispute resolution body. The consumer also retains the right to apply to a court in accordance with the applicable laws of the Republic of Latvia.
